Besides, you should also:

  • Have no prior violations of immigration status.
  • Have no criminal history.
  • Have your Immigrant Petition by Alien Entrepreneur, submitted priorly, approved.

Thus, you can self-petition for the EB-5 Green Card. But first you’d have to file the Immigrant Petition by Alien Entrepreneur and have it approved. Note, that there are no requirements for your educational background, so you don’t need a degree to file your petition. Neither do you need the PERM Labor Certification.

If, at the time of filing, you are not in the US, you’d have to go through the so-called Consular Processing. Bringing foreign nationals to the US through Consular Processing is a primary way to obtain a green card (permanent resident status) for either employment or family-based applicants.
